,QGLYLGXDO XVLQJ GHDGO\ IRUFH RU IRUFH RWKHU WKDQ GHDGO\ IRUFH SUHVXPSWLRQ GH¿QLWLRQV 6HF ([FHSW DV SURYLGHG LQ VXEVHFWLRQ LW LV D UHEXWWDEOH SUHVXPSWLRQ LQ D FLYLO RU FULPLQDO FDVH WKDW DQ LQGLYLGXDO ZKR XVHV GHDGO\ IRUFH RU IRUFH RWKHU WKDQ GHDGO\ IRUFH XQGHU VHFWLRQ RI WKH VHOI GHIHQVH DFW KDV DQ KRQHVW DQG UHDVRQDEOH EHOLHI WKDW LPPLQHQW GHDWK RI VH[XDO DVVDXOW RI RU JUHDW ERGLO\ KDUP WR KLPVHOI RU KHUVHOI RU DQRWKHU LQGLYLGXDO ZLOO RFFXU LI both of the following apply: (a) The individual against whom deadly force or force other than deadly force is used is in the process of breaking and entering a dwelling or business premises or committing home invasion or has broken and entered a dwelling or business premises or committed home invasion and is still present in the dwelling or business premises, or is unlawfully attempting to remove another individual from a dwelling, business premises, or occupied vehicle against his or her will. (b) The individual using deadly force or force other than deadly force honestly and reasonably believes that the individual is engaging in conduct described in subdivision (a). 7KH SUHVXPSWLRQ VHW IRUWK LQ VXEVHFWLRQ GRHV QRW DSSO\ LI DQ\ RI WKH IROORZLQJ FLUFXPVWDQFHV H[LVW (a) The individual against whom deadly force or force other than deadly force is used, including an owner, lessee, or WLWOHKROGHU KDV WKH OHJDO ULJKW WR EH LQ WKH GZHOOLQJ EXVLQHVV SUHPLVHV RU YHKLFOH DQG WKHUH LV QRW DQ LQMXQFWLRQ IRU SURWHFWLRQ from domestic violence or a written pretrial supervision order, a probation order, or a parole order of no contact against that person. (b) The individual removed or being removed from the dwelling, business premises, or occupied vehicle is a child or grandchild of, or is otherwise in the lawful custody of or under the lawful guardianship of, the individual against whom deadly force or force other than deadly force is used. (c) The individual who uses deadly force or force other than deadly force is engaged in the commission of a crime or is using the dwelling, business premises, or occupied vehicle to further the commission of a crime. G 7KH LQGLYLGXDO DJDLQVW ZKRP GHDGO\ IRUFH RU IRUFH RWKHU WKDQ GHDGO\ IRUFH LV XVHG LV D SHDFH RI¿FHU ZKR KDV HQWHUHG RU LV DWWHPSWLQJ WR HQWHU D GZHOOLQJ EXVLQHVV SUHPLVHV RU YHKLFOH LQ WKH SHUIRUPDQFH RI KLV RU KHU RI¿FLDO GXWLHV LQ DFFRUGDQFH with applicable law. (e) The individual against whom deadly force or force other than deadly force is used is the spouse or former spouse of the individual using deadly force or force other than deadly force, an individual with whom the individual using deadly force or other than deadly force has or had a dating relationship, an individual with whom the individual using deadly force or other than deadly force has had a child in common, or a resident or former resident of his or her household, and the individual using deadly force or other than deadly force has a prior history of domestic violence as the aggressor. (3) As used in this section: D ³'RPHVWLF YLROHQFH´ PHDQV WKDW WHUP DV GH¿QHG LQ VHFWLRQ RI 3$ 0&/ (b) “Business premises” means a building or other structure used for the transaction of business, including an appurtenant structure attached to that building or other structure. F ³'ZHOOLQJ´ PHDQV D VWUXFWXUH RU VKHOWHU WKDW LV XVHG SHUPDQHQWO\ RU WHPSRUDULO\ DV D SODFH RI DERGH LQFOXGLQJ DQ appurtenant structure attached to that structure or shelter. G ³/DZ HQIRUFHPHQW RI¿FHU RI D 0LFKLJDQ ,QGLDQ WULEDO SROLFH IRUFH´ PHDQV D UHJXODUO\ HPSOR\HG PHPEHU RI D SROLFH IRUFH of a Michigan Indian tribe who is appointed pursuant to former 25 CFR 12.100 to 12.103. H ³0LFKLJDQ ,QGLDQ WULEH´ PHDQV D IHGHUDOO\ UHFRJQL]HG ,QGLDQ WULEH WKDW KDV WUXVW ODQGV ORFDWHG ZLWKLQ WKLV VWDWH I ³3HDFH RI¿FHU´ PHDQV DQ\ RI WKH IROORZLQJ ( i $ UHJXODUO\ HPSOR\HG PHPEHU RI D ODZ HQIRUFHPHQW DJHQF\ DXWKRUL]HG DQG HVWDEOLVKHG SXUVXDQW WR ODZ LQFOXGLQJ common law, who is responsible for the prevention and detection of crime and the enforcement of the general criminal laws of WKLV VWDWH 3HDFH RI¿FHU GRHV QRW LQFOXGH D SHUVRQ VHUYLQJ VROHO\ EHFDXVH KH RU VKH RFFXSLHV DQ\ RWKHU RI¿FH RU SRVLWLRQ ( ii $ ODZ HQIRUFHPHQW RI¿FHU RI D 0LFKLJDQ ,QGLDQ WULEDO SROLFH IRUFH ( iii ) The sergeant at arms or any assistant sergeant at arms of either house of the legislature who is commissioned as a police RI¿FHU E\ WKDW UHVSHFWLYH KRXVH RI WKH OHJLVODWXUH DV SURYLGHG E\ WKH OHJLVODWLYH VHUJHDQW DW DUPV SROLFH SRZHUV DFW 3$ MCL 4.381 to 4.382. ( iv $ ODZ HQIRUFHPHQW RI¿FHU RI D PXOWLFRXQW\ PHWURSROLWDQ GLVWULFW ( v $ FRXQW\ SURVHFXWLQJ DWWRUQH\¶V LQYHVWLJDWRU VZRUQ DQG IXOO\ HPSRZHUHG E\ WKH VKHULII RI WKDW FRXQW\ ( vi 8QWLO 'HFHPEHU D ODZ HQIRUFHPHQW RI¿FHU RI D VFKRRO GLVWULFW LQ WKLV VWDWH WKDW KDV D PHPEHUVKLS RI DW OHDVW 20,000 pupils and that includes in its territory a city with a population of at least 180,000 as of the most recent federal decennial census.
