With the informed consent of the victim, the court may also order the defendant to provide the victim of the charged crime with an electronic receptor device capable of receiving the global positioning system LQIRUPDWLRQ IURP WKH HOHFWURQLF PRQLWRULQJ GHYLFH ZRUQ E\ WKH GHIHQGDQW WKDW QRWL¿HV WKH YLFWLP LI WKH GHIHQGDQW LV ORFDWHG ZLWKLQ D SUR[LPLW\ WR WKH YLFWLP DV GHWHUPLQHG E\ WKH MXGJH RU GLVWULFW FRXUW PDJLVWUDWH LQ FRQVXOWDWLRQ ZLWK WKH YLFWLP 7KH victim shall also be furnished with a telephone contact with the local law enforcement agency to request immediate assistance LI WKH GHIHQGDQW LV ORFDWHG ZLWKLQ WKDW SUR[LPLW\ WR WKH YLFWLP ,Q DGGLWLRQ WKH YLFWLP PD\ SURYLGH WKH FRXUW ZLWK D OLVW RI DUHDV IURP ZKLFK KH RU VKH ZRXOG OLNH WKH GHIHQGDQW H[FOXGHG 7KH FRXUW VKDOO FRQVLGHU WKH YLFWLP¶V UHTXHVW DQG VKDOO GHWHUPLQH ZKLFK DUHDV WKH GHIHQGDQW VKDOO EH SURKLELWHG IURP DFFHVVLQJ 7KH FRXUW VKDOO LQVWUXFW WKH HQWLW\ PRQLWRULQJ WKH GHIHQGDQW¶V SRVLWLRQ to notify the proper authorities if the defendant violates the order. In determining whether to order a defendant to wear an HOHFWURQLF PRQLWRULQJ GHYLFH WKH FRXUW VKDOO FRQVLGHU WKH OLNHOLKRRG WKDW WKH GHIHQGDQW¶V SDUWLFLSDWLRQ LQ HOHFWURQLF PRQLWRULQJ ZLOO GHWHU WKH GHIHQGDQW IURP VHHNLQJ WR NLOO SK\VLFDOO\ LQMXUH VWDON RU RWKHUZLVH WKUHDWHQ WKH YLFWLP SULRU WR WULDO 7KH YLFWLP PD\ UHTXHVW WKH FRXUW WR WHUPLQDWH WKH YLFWLP¶V SDUWLFLSDWLRQ LQ WKH PRQLWRULQJ RI WKH GHIHQGDQW DW DQ\ WLPH 7KH FRXUW VKDOO QRW impose sanctions on the victim for refusing to participate in monitoring under this subsection. A defendant described in this subsection shall only be released if he or she agrees to pay the cost of the device and any monitoring as a condition of release or to perform community service work in lieu of paying that cost. An electronic monitoring device ordered to be worn under this VXEVHFWLRQ VKDOO SURYLGH UHOLDEOH QRWL¿FDWLRQ RI UHPRYDO RU WDPSHULQJ $V XVHG LQ WKLV VXEVHFWLRQ D ³$VVDXOWLYH FULPH´ PHDQV WKDW WHUP DV GH¿QHG LQ VHFWLRQ D RI FKDSWHU ; E ³'RPHVWLF YLROHQFH´ PHDQV WKDW WHUP DV GH¿QHG LQ VHFWLRQ RI 3$ 0&/ F ³(OHFWURQLF PRQLWRULQJ GHYLFH´ LQFOXGHV DQ\ HOHFWURQLF GHYLFH RU LQVWUXPHQW WKDW LV XVHG WR WUDFN WKH ORFDWLRQ RI DQ LQGLYLGXDO RU WR PRQLWRU DQ LQGLYLGXDO¶V EORRG DOFRKRO FRQWHQW EXW GRHV QRW LQFOXGH DQ\ WHFKQRORJ\ WKDW LV LPSODQWHG RU YLRODWHV the corporeal body of the individual. (d) “Informed consent” means that the victim was given information concerning all of the following before consenting to participate in electronic monitoring: ( i 7KH YLFWLP¶V ULJKW WR UHIXVH WR SDUWLFLSDWH LQ WKDW PRQLWRULQJ DQG WKH SURFHVV IRU UHTXHVWLQJ WKH FRXUW WR WHUPLQDWH WKH YLFWLP¶V SDUWLFLSDWLRQ DIWHU LW KDV EHHQ RUGHUHG ( ii 7KH PDQQHU LQ ZKLFK WKH PRQLWRULQJ WHFKQRORJ\ IXQFWLRQV DQG WKH ULVNV DQG OLPLWDWLRQV RI WKDW WHFKQRORJ\ DQG WKH H[WHQW WR ZKLFK WKH V\VWHP ZLOO WUDFN DQG UHFRUG WKH YLFWLP¶V ORFDWLRQ DQG PRYHPHQWV ( iii ) The boundaries imposed on the defendant during the monitoring program. ( iv ) Sanctions that the court may impose on the defendant for violating an order issued under this subsection. ( v ) The procedure that the victim is to follow if the defendant violates an order issued under this subsection or if monitoring equipment fails to operate properly. ( vi ,GHQWL¿FDWLRQ RI VXSSRUW VHUYLFHV DYDLODEOH WR DVVLVW WKH YLFWLP WR GHYHORS D VDIHW\ SODQ WR XVH LI WKH FRXUW¶V RUGHU LVVXHG under this subsection is violated or if the monitoring equipment fails to operate properly. ( vii ,GHQWL¿FDWLRQ RI FRPPXQLW\ VHUYLFHV DYDLODEOH WR DVVLVW WKH YLFWLP LQ REWDLQLQJ VKHOWHU FRXQVHOLQJ HGXFDWLRQ FKLOG care, legal representation, and other help in addressing the consequences and effects of domestic violence. ( viii 7KH QRQFRQ¿GHQWLDO QDWXUH RI WKH YLFWLP¶V FRPPXQLFDWLRQV ZLWK WKH FRXUW FRQFHUQLQJ HOHFWURQLF PRQLWRULQJ DQG WKH UHVWULFWLRQV WR EH LPSRVHG XSRQ WKH GHIHQGDQW¶V PRYHPHQWV (c) A statement of the date the conditions become effective. G $ VWDWHPHQW RI WKH GDWH RQ ZKLFK WKH RUGHU ZLOO H[SLUH (e) A statement of the conditions imposed.
