GHSDUWPHQW RI VWDWH SROLFH ,I WKH DSSOLFDQW KDV EHHQ WKH VXEMHFW RI D FULPLQDO KLVWRU\ FKHFN FRQGXFWHG LQ FRPSOLDQFH ZLWK WKLV VHFWLRQ WKH DSSOLFDQW VKDOO JLYH ZULWWHQ FRQVHQW DW WKH WLPH RI DSSOLFDWLRQ IRU WKH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ WR REWDLQ WKH FULPLQDO KLVWRU\ UHFRUG LQIRUPDWLRQ DV SUHVFULEHG LQ VXEVHFWLRQ IURP WKH relevant licensing or regulatory department and for the department of state police to conduct a criminal history check under this section if the requirements of subsection (10) are not met and a request to the federal bureau of investigation to make a GHWHUPLQDWLRQ RI WKH H[LVWHQFH RI DQ\ QDWLRQDO FULPLQDO KLVWRU\ SHUWDLQLQJ WR WKH DSSOLFDQW LV QHFHVVDU\ DORQJ ZLWK LGHQWL¿FDWLRQ DFFHSWDEOH WR WKH GHSDUWPHQW RI VWDWH SROLFH 8SRQ UHFHLSW RI WKH ZULWWHQ FRQVHQW WR REWDLQ WKH FULPLQDO KLVWRU\ UHFRUG LQIRUPDWLRQ DQG LGHQWL¿FDWLRQ UHTXLUHG XQGHU WKLV VXEVHFWLRQ WKH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ WKDW KDV PDGH D JRRG IDLWK RIIHU RI HPSOR\PHQW RU DQ LQGHSHQGHQW FRQWUDFW RU FOLQLFDO SULYLOHJHV WR WKH DSSOLFDQW VKDOO request the criminal history record information from the relevant licensing or regulatory department and shall make a request regarding that applicant to the relevant licensing or regulatory department to conduct a check of all relevant registries in the manner required in subsection (4). If the requirements of subsection (10) are not met and a request to the federal bureau of LQYHVWLJDWLRQ WR PDNH D VXEVHTXHQW GHWHUPLQDWLRQ RI WKH H[LVWHQFH RI DQ\ QDWLRQDO FULPLQDO KLVWRU\ SHUWDLQLQJ WR WKH DSSOLFDQW LV QHFHVVDU\ WKH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ VKDOO SURFHHG LQ WKH PDQQHU UHTXLUHG LQ VXEVHFWLRQ $ VWDI¿QJ DJHQF\ WKDW HPSOR\V DQ DSSOLFDQW ZKR UHJXODUO\ KDV GLUHFW DFFHVV WR RU SURYLGHV GLUHFW VHUYLFHV WR SDWLHQWV RU UHVLGHQWV XQGHU DQ LQGHSHQGHQW FRQWUDFW ZLWK D SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G VKDOO VXEPLW LQIRUPDWLRQ UHJDUGLQJ WKH FULPLQDO KLVWRU\ FKHFN FRQGXFWHG E\ WKH VWDI¿QJ DJHQF\ WR WKH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G WKDW KDV PDGH D JRRG IDLWK RIIHU RI LQGHSHQGHQW FRQWUDFW WR that applicant. 8SRQ UHFHLSW RI WKH ZULWWHQ FRQVHQW WR FRQGXFW D FULPLQDO KLVWRU\ FKHFN DQG LGHQWL¿FDWLRQ UHTXLUHG XQGHU VXEVHFWLRQ D SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ WKDW KDV PDGH D JRRG IDLWK RIIHU RI employment or an independent contract or clinical privileges to the applicant shall make a request to the department of state SROLFH WR FRQGXFW D FULPLQDO KLVWRU\ FKHFN RQ WKH DSSOLFDQW WR LQSXW WKH DSSOLFDQW¶V ¿QJHUSULQWV LQWR WKH DXWRPDWHG ¿QJHUSULQW LGHQWL¿FDWLRQ V\VWHP GDWDEDVH DQG WR IRUZDUG WKH DSSOLFDQW¶V ¿QJHUSULQWV WR WKH IHGHUDO EXUHDX RI LQYHVWLJDWLRQ 7KH GHSDUWPHQW RI VWDWH SROLFH VKDOO UHTXHVW WKH IHGHUDO EXUHDX RI LQYHVWLJDWLRQ WR PDNH D GHWHUPLQDWLRQ RI WKH H[LVWHQFH RI DQ\ QDWLRQDO FULPLQDO KLVWRU\ SHUWDLQLQJ WR WKH DSSOLFDQW 7KH DSSOLFDQW VKDOO SURYLGH WKH GHSDUWPHQW RI VWDWH SROLFH ZLWK D VHW RI ¿QJHUSULQWV 7KH UHTXHVW VKDOO EH PDGH LQ D PDQQHU SUHVFULEHG E\ WKH GHSDUWPHQW RI VWDWH SROLFH 7KH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ VKDOO PDNH WKH ZULWWHQ FRQVHQW DQG LGHQWL¿FDWLRQ DYDLODEOH WR WKH GHSDUWPHQW RI VWDWH SROLFH 7KH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ VKDOO PDNH D UHTXHVW UHJDUGLQJ that applicant to the relevant licensing or regulatory department to conduct a check of all relevant registries established under IHGHUDO DQG VWDWH ODZ DQG UHJXODWLRQV IRU DQ\ VXEVWDQWLDWHG ¿QGLQJV RI DEXVH QHJOHFW RU PLVDSSURSULDWLRQ RI SURSHUW\ ,I WKH department of state police or the federal bureau of investigation charges a fee for conducting the criminal history check, WKH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ VKDOO SD\ WKH FRVW RI WKH FKDUJH 7KH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ VKDOO QRW VHHN UHLPEXUVHPHQW IRU D FKDUJH LPSRVHG E\ WKH GHSDUWPHQW RI VWDWH SROLFH RU WKH IHGHUDO EXUHDX RI LQYHVWLJDWLRQ IURP WKH LQGLYLGXDO ZKR LV WKH VXEMHFW RI WKH criminal history check. A prospective employee or a prospective independent contractor covered under this section may not be charged for the cost of a criminal history check required under this section. The department of state police shall conduct a criminal history check on the applicant named in the request. The department of state police shall provide the department with a written report of the criminal history check conducted under this subsection. The report shall contain any criminal history record information on the applicant maintained by the department of state police. The department of state police shall provide the results of the federal bureau of investigation determination to the department within 30 days after the request is made. If WKH UHTXHVWLQJ SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ LV QRW D VWDWH GHSDUWPHQW RU agency and if criminal history record information is disclosed on the written report of the criminal history check or the federal bureau of investigation determination that resulted in a conviction, the department shall notify the psychiatric facility or other IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ DQG WKH DSSOLFDQW LQ ZULWLQJ RI WKH W\SH RI FULPH GLVFORVHG RQ WKH ZULWWHQ report of the criminal history check or the federal bureau of investigation determination without disclosing the details of the crime. Any charges imposed by the department of state police or the federal bureau of investigation for conducting a criminal history check or making a determination under this subsection shall be paid in the manner required under this subsection. The notice shall include a statement that the applicant has a right to appeal the information relied upon by the psychiatric facility RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G RU VWDI¿QJ DJHQF\ UHJDUGLQJ KLV RU KHU HPSOR\PHQW HOLJLELOLW\ EDVHG RQ WKH FULPLQDO KLVWRU\ FKHFN 7KH QRWLFH VKDOO DOVR LQFOXGH LQIRUPDWLRQ UHJDUGLQJ ZKHUH WR ¿OH DQG GHVFULELQJ WKH DSSHOODWH SURFHGXUHV HVWDEOLVKHG XQGHU VHFWLRQ E RI WKH SXEOLF KHDOWK FRGH 3$ 0&/ E ,I D SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G GHWHUPLQHV LW QHFHVVDU\ WR HPSOR\ RU JUDQW FOLQLFDO SULYLOHJHV WR DQ DSSOLFDQW EHIRUH UHFHLYLQJ WKH UHVXOWV RI WKH DSSOLFDQW¶V FULPLQDO KLVWRU\ FKHFN RU FULPLQDO KLVWRU\ UHFRUG LQIRUPDWLRQ XQGHU WKLV VHFWLRQ WKH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G PD\ FRQGLWLRQDOO\ HPSOR\ or grant conditional clinical privileges to the individual if all of the following apply: D 7KH SV\FKLDWULF IDFLOLW\ RU RWKHU IDFLOLW\ GH¿QHG LQ 86& G G UHTXHVWV WKH FULPLQDO KLVWRU\ FKHFN RU FULPLQDO history record information under this section upon conditionally employing or conditionally granting clinical privileges to the individual. (b) The individual signs a statement in writing that indicates all of the following: ( i ) That he or she has not been convicted of 1 or more of the crimes that are described in subsection (1)(a) through (g) within the applicable time period prescribed by each subdivision respectively.
