(1) County clerks shall provide concealed pistol application kits during normal business hours and free of charge to LQGLYLGXDOV ZKR ZLVK WR DSSO\ IRU OLFHQVHV WR FDUU\ FRQFHDOHG SLVWROV (DFK NLW VKDOO RQO\ FRQWDLQ DOO RI WKH IROORZLQJ (a) A concealed pistol license application form provided by the director of the department of state police. E 7KH ¿QJHUSULQW FDUGV XQGHU VHFWLRQ E LI UHTXLUHG (c) Written information regarding the procedures involved in obtaining a license to carry a concealed pistol. G :ULWWHQ LQIRUPDWLRQ LGHQWLI\LQJ HQWLWLHV WKDW RIIHU WKH WUDLQLQJ UHTXLUHG XQGHU VHFWLRQ E F LI PDLQWDLQHG E\ WKH county clerk. (2) A county clerk shall not deny an individual the right to receive a concealed pistol application kit under this section. (3) An individual who is denied an application kit under this section and obtains an order of mandamus directing the county clerk to provide him or her with the application kit shall be awarded his or her actual and reasonable costs and attorney fees for obtaining the order. (4) The department of state police shall provide the application kits required under this section to county clerks in an electronic format. The department of state police shall not charge a fee for the kits. F ,VVXLQJ QRWLFHV RI VWDWXWRU\ GLVTXDOL¿FDWLRQ QRWLFHV RI VXVSHQVLRQV DQG QRWLFHV RI UHYRFDWLRQV (3) The department of state police shall verify under section 5b(6) whether an applicant for a license to carry a concealed pistol is eligible to receive a license to carry a concealed pistol. (4) A county clerk shall issue an emergency license to carry a concealed pistol to an individual if the individual has REWDLQHG D SHUVRQDO SURWHFWLRQ RUGHU LVVXHG XQGHU VHFWLRQ RU D RI WKH UHYLVHG MXGLFDWXUH DFW RI 3$ 0&/ DQG D RU WR WKDW LQGLYLGXDO LI D FRXQW\ VKHULII GHWHUPLQHV WKDW WKHUH LV FOHDU DQG FRQYLQFLQJ HYLGHQFH WR EHOLHYH WKH VDIHW\ RI WKH LQGLYLGXDO RU WKH VDIHW\ RI D PHPEHU RI WKH LQGLYLGXDO¶V IDPLO\ RU KRXVHKROG LV HQGDQJHUHG E\ WKH LQGLYLGXDO¶V LQDELOLW\ WR LPPHGLDWHO\ REWDLQ D OLFHQVH WR FDUU\ D FRQFHDOHG SLVWRO &OHDU DQG FRQYLQFLQJ HYLGHQFH LQFOXGHV EXW is not limited to, an application for a personal protection order, police reports and other law enforcement records, or written, DXGLR RU YLVXDO HYLGHQFH RI WKUHDWV WR WKH LQGLYLGXDO RU PHPEHU RI WKH LQGLYLGXDO¶V IDPLO\ RU KRXVHKROG $ FRXQW\ FOHUN VKDOO only issue an emergency license to carry a concealed pistol to an individual who has obtained a personal protection order if WKH LQGLYLGXDO LV HOLJLEOH XQGHU VHFWLRQ E G H I K L M N DQG P WR UHFHLYH D OLFHQVH EDVHG RQ D FULPLQDO UHFRUG check through the law enforcement information network conducted by the department of state police. The county sheriff shall RQO\ LVVXH D GHWHUPLQDWLRQ XQGHU WKLV VXEVHFWLRQ WR DQ LQGLYLGXDO ZKR LV HOLJLEOH XQGHU VHFWLRQ E G H I K L M (k), and (m) to receive a license based on a criminal record check through the law enforcement information network and only DIWHU WKH FRXQW\ VKHULII KDV WDNHQ WKH LQGLYLGXDO¶V ¿QJHUSULQWV LQ FRPSOLDQFH ZLWK VHFWLRQ E $ FRXQW\ VKHULII VKDOO QRWLI\ WKH FRXQW\ FOHUN LI WKH FRXQW\ VKHULII GHWHUPLQHV WKDW DQ LQGLYLGXDO LV QRW HOLJLEOH XQGHU VHFWLRQ E G H I K L M N or (m) to receive a license. An emergency license must be on a form provided by the department of state police.
