 The Power of Life and Death is yours to make.  The Concealed Handgun is an EMERGECY TOOL that is used in an EMERGENCY SITUATION when deadly force is required to protect human life.  A person can be held criminally and civilly liable for wrongfully pointing or discharging a pistol at another person. This could result in trauma to yourself and your family, the loss of freedom, loss of employment, related wages and health benefits, and future wages and employment. There is always the possibility of prosecution and/or a wrongful death lawsuit .  True self defense is when you are the innocent victim of someone else's actions, you did not cause the situation, you did not start the incident and you are forced to take action to defend yourself . Defending others is an option only you can make.

 Under the Michigan CPL laws a handgun is the only “weapon ” you can carry concealed.  Preemption The state controls CPL laws - local government cannot have more restrictive or different laws.  Reciprocity Another state allows a Michigan resident to carry a handgun in that state according to that states laws.

Qualification and Handguns

 You can qualify for the CPL class with any caliber of handgun.  You are not required to qualify for the CPL class with the handgun you will carry.  The CPL is attached to you ‐ not a specific handgun  You are not required by law to re ‐ qualify or demonstrate proficiency with a CPL instructor to carry other handguns purchased after you qualify for the CPL.

8  The CPL license is valid for 5 years  The First-time initial CPL license will expire on your birthday of the 4 th or 5th year.  The renewal of your license will expire on your birthday of the 5 th year  You are notified of the expiration date by your county clerk 3-6 months before license expires .  After receiving your CPL you can carry any other handgun without qualifying with an instructor.

 The renewal applicant can apply 6 months before to one year after the CPL expiration date.  Renewal requires the CPL holder to complete 3 hours of "required" training and one hour at the range within the preceding 6 months prior to re-applying for their CPL  “Required” meaning up-to-date regardi ng all applicable laws and CPL carry requirements.  Shooting skills should be at the new applicant level.

10  There is no minimum number of handguns that you can carry concealed.

 There is no “mandated” syllabus for renewal training recurrent training during the duration of your license, just the requirement to maintain your knowledge and skills.  “Renewal study” does not mandate CPL instructor training .  You will only be as good as you want to be!

 You are required to know how to find and stay current on all applicable laws.  You are required to know the laws of other states where you intend to carry your handgun.  You are required to know and demonstrate safe operation of your concealed carry handgun.  You are required to maintain your CPL shooting skills.

 You can carry a handgun on most forms of transportation as long as that does not violate other laws. Refer to TSA and state law for rules regarding public transportation.  You do not need a CPL to carry concealed on your property or lands possessed by you.

14  All purchase, sales or transfers must be done in the state of Michigan by residents of Michigan that can legally sell and purchase a handgun.  Handguns acquired out of state by a resident of Michigan must be transferred from the out of state source into the state of Michigan through (FFL) Federally Licensed Gun Dealers (transfer fees usually apply).

 The term CCW and CPL are used interchangeably to identify the license to carry a handgun.  The purchase of a handgun and the CPL application process are two different procedures that are independent of each other.  The purchase of a handgun is processed by your local police department.  The concealed pistol license is processed by your county clerk.

 You may be criminally and civilly liable for any harm caused by a person less than 18 years of age who lawfully gains unsupervised access to your firearm if unlawfully stored.  As such, a trigger lock, gun case or other device designed to prevent unauthorized access to a firearm is strongly recommended.

 The owner of a handgun can “loan” a handgun to a person that has a valid CPL.  The CPL holder can possess / carry the handgun without the owner's presence.  The owner of a handgun can let another person without a CPL “use” the handgun with the owner present.

Concealed Carry and Definitions

 Concealed carry rules apply to the person and vehicle. Concealed carry means to carry or place the handgun so as not to seen or identified as a handgun.  A concealed pistol permit is required if the handgun is "accessible" to the driver of the vehicle.  “inaccessible” means to place in a location such as a trunk or in a locked container.

 Summary overview  PA 309 creates the Self Defense Act and specifies that it is not a crime to use force or deadly force to defend oneself if that person is not breaking any laws when defensive force was used.  PA 310 puts the burden of proof on the prosecutor to show that a person acted unlawfully in the application of force, rather than the person using the force having to prove they acted lawfully.

 Act No. 313 This expands the definition of “dwelling” to include a person’s garage, barn, backyard, etc.  The People of the State of Michigan enact :  Sec. 21c. (1) In cases in which section 2 of the self-defense act does not apply, the common law of this state applies except that the duty to retreat before using deadly force is not required if an individual is in his or her own dwelling or within the curtilage of that dwelling.  (2 ) As used in this section, "dwelling " means a structure or shelter that is used permanently or temporarily as a place of abode, including an appurtenant structure attached to that structure or shelter.

 Open carry of a pistol...revisited  In the April 2007 edition of the Update we noted that openly (non ‐ concealed) carrying a pistol in Michigan is generally legal. Here we will note a couple of things to keep in mind during open carry situations.  First, a person may not “open carry " a pistol in the passenger compartment of a vehicle. Once a person enters a passenger compartment with a pistol they are carrying it concealed in violation of MCL 750.227 .  In order to carry in a passenger compartment, a person must either be licensed to carry a concealed pistol or otherwise be exempted from Section 227 (e.g., a police officer)

 Public Act 98 of 2018 amended the definition of "self- defense spray or foam device" under MCL 750.224d. The maximum amount of allowed OC was changed from a solution containing not more than 10 percent OC to a solution containing not more than 18 percent OC. Also, Public Act 98 added to the definition of "self-defense spray or foam device" a solution containing an ultraviolet dye that is not more than 18 percent OC.

cover  Cover is defined, for our purposes, as anything which will stop a bullet. It is anything you can hide yourself behind which will not allow bullets to penetrate and hit you. Some examples are a telephone pole, a concrete wall or building, certain parts of an automobile (engine block, axles, wheels, and a heavy steel mailbox. Most wood walls and nearly all interior walls of both residences and businesses and wood or metal doors will not provide cover- they will not stop bullets . 

 Concealment is defined as anything which hides you but will not stop a bullet. Concealment is obviously not as good as cover but if your assailant cannot see you then he or she may not be able to shoot you. Some examples of concealment are: shrubs, sheetrock walls, tall grass, hollow- core wood doors.

National Parks – Possession of Firearm

 The U.S. Fish and Wildlife Service today announced that effective February 22, 2010, the rules governing possession of firearms on National Wildlife Refuges will change as a result of legislation enacted by Congress. After this date, the law allows an individual to lawfully possess a firearm within the boundaries of a National Wildlife Refuge in accordance with federal, state, and local firearms laws.

 The new law applies to all 551 units of the National Wildlife Refuge System, as well as the National Monuments and the 392 units of the National Park System.

 While possession on a refuge may generally be allowed under state law, possession of firearms will remain prohibited in Federal facilities. Examples include, visitor centers, refuge administrative office buildings, refuge maintenance offices and workshops, field and backcountry offices, ranger stations and fee collection stations.

 Federal law provides a person, who is not prohibited by the GCA from receiving or transporting firearms, the right to transport a firearm under certain conditions, notwithstanding state or local law to the contrary. The firearms must be unloaded and in a locked trunk or, in a vehicle lacking a trunk, in a locked container other than the glove compartment or console. Also, the carrying and possession must be lawful at the place of origin and destination .

 The Gun Control Act of 1968 (GCA or GCA68) is a U.S. federal law that regulates the firearms industry and firearms owners. It primarily focuses on regulating interstate commerce in firearms by generally prohibiting interstate firearms transfers except among licensed manufacturers dealers and importers.

Fed law ‐ Shipping  A non-licensee may ship a firearm by carrier to a resident of his or her own state or to a licensee in any state. A common or contract carrier must be used to ship a handgun . In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm..

76  If you must shoot to protect yourself, be sure you have properly identified the target as the intruder. Do not shoot through doors, walls or other objects at the suspected intruder  Because there is no duty to retreat does not give you the right to shoot the intruder just because he is in your home. The two most important shooting fundamentals are sight alignment and trigger control.

When a cartridge fails to fire immediately, you should keep the pistol pointed in a safe direction and, after waiting at least 15 seconds (as a precaution in case of a hang fire), open the action and remove the cartridge. When gripping the pistol, you should use the same grip each time that you hold the pistol.
