Power and Responsibility
48
The Power of Life and Death is yours to make. The Concealed Handgun is an EMERGECY TOOL that is used in an EMERGENCY SITUATION when deadly force is required to protect human life. True self defense is when you are the innocent victim of someone else's actions, you did not cause the situation, you did not start the incident and you are forced to take action to defend yourself . Defending others is an option only you can make .

Power and Responsibility

A word of caution-- A person can be held criminally and civilly liable for wrongfully pointing or discharging a pistol at another person. This could result in trauma to yourself and your family, the loss of freedom, loss of employment, related wages and health benefits, and future wages and employment. Self D f n
i s r c i s
50
Self-defense is another often used defense. In certain crimes, the prosecution has the burden of proving beyond a reasonable doubt that the defendant was not acting in self- defense.
The law recognizes the right of a person to use force or even take a life in defense of his own person under certain circumstances.
When a person acts in lawful self-defense, such actions are excused, and the defendant is not guilty of any crime.

Self D f n

51
Even if the defendant's perceptions of the incident at hand are false and he was mistaken as to the extent of the real danger, he is to be judged by the circumstances as they appeared to him at the time of the act. The defendant does not have to prove that [he/she] acted in self- defense. Instead, the prosecutor must prove beyond a reasonable doubt that the defendant did not act in self-defense.

Elements of a crime
52
The three specific elements (with exception) that define a crime which the prosecution must prove beyond a reasonable doubt in order to obtain a conviction: (1) that a crime has actually occurred (actus reus), (2) that the accused intended the crime to happen ( mens rea ) and (3) and concurrence of the two meaning there is a timely relationship between the first two factors.
Handgun Training Specialists
5/23/2021
Transferred intent
53
Transferred intent is used when a defendant intends to harm one victim, but then unintentionally harms a second victim instead. In this case, the defendant's intent transfers from the intended victim to the actual victim and can be used to satisfy the mens rea element of the crime that the defendant is being charged with. The transferred intent doctrine is only used for completed crimes, and is not used for attempted crimes. Mens Rea As an element of criminal responsibility, a guilty mind; a guilty or wr ongful purpose; a criminal intent. Guilty knowledge and willfulness

Legal Update – May 2007
74
Open carry of a pistol...revisited In the April 2007 edition of the Update we noted that openly (non ‐ concealed) carrying a pistol in Michigan is generally legal. Here we will note a couple of things to keep in mind during open carry situations. First, a person may not “open carry " a pistol in the passenger compartment of a vehicle. Once a person enters a passenger compartment with a pistol they are carrying it concealed in violation of MCL 750.227 . In order to carry in a passenger compartment, a person must either be licensed to carry a concealed pistol or otherwise be exempted from Section 227 (e.g., a police officer)

cover Cover is defined, for our purposes, as anything which will stop a bullet. It is anything you can hide yourself behind which will not allow bullets to penetrate and hit you. Some examples are a telephone pole, a concrete wall or building, certain parts of an automobile (engine block, axles, wheels, and a heavy steel mailbox. Most wood walls and nearly all interior walls of both residences and businesses and wood or metal doors will not provide cover- they will not stop bullets .

94 If you must shoot to protect yourself, be sure you have properly identified the target as the intruder. Do not shoot through doors, walls or other objects at the suspected intruder Because there is no duty to retreat does not give you the right to shoot the intruder just because he is in your home. Your justification is always self ‐ defense. Target identification must be visual .

Cover
97
Cover is defined, for our purposes, as anything which will stop a bullet.

98
Concealment is defined as anything which hides you but will not stop a bullet. Concealment is obviously not as good as cover but if your assailant cannot see you then he or she may not be able to shoot you. Some examples of concealment are: shrubs, sheetrock walls, tall grass, hollow- core wood doors.

The two most important shooting fundamentals are sight alignment and trigger control.
When a cartridge fails to fire immediately, you should keep the pistol pointed in a safe direction and, after waiting at least 15 seconds (as a precaution in case of a hang fire), open the action and remove the cartridge.
When gripping the pistol, you should use the same grip each time that you hold the pistol.
